A DWI arrest (or DUI as it is often referred to as) can put your license, job, and freedom at risk. But not every charge is open-and-shut. I dig into the details of the stop, the testing procedures, and the evidence to find weak points that could lead to reduced or dismissed charges.
I represent clients charged with driving while impaired in New Hanover, Brunswick, and Pender Counties. Whether it’s your first DWI/DUI or not, you need someone who knows the system and will fight for your future.
Note, in NC, DWI refers to driving while impaired. I use the term DUI because sometimes people refer to DWIs as DUIs.
First DWI/DUI Charge though?
It was very likely a scary experience: being handcuffed, being taken to jail, and being read your implied consent rights. You probably couldn't remember anyone's phone number and didn't know what to say or do. That's okay. Most people charged with a DWI are in the same boat. Let's talk through everything that happened and what it means for your defense to this DWI charge. Call now to schedule a consult.
What about the physical tests I did on the roadside?
These are known as Standardized Field Sobriety Tests (SFSTs). SFSTs are designed to help law enforcement decide if you're appreciably impaired to an extent that makes it illegal to drive on the road.
You probably did the eye test (Horizontal Gaze Nystagmus), where you stare at the officer's finger while a bright light shines above you. Then there is the walking test (Walk and Turn), where hopefully you didn't have to walk on an imaginary line. Then there is the One Leg Stand test, where you count to 30 seconds in your head.
Either way, there is a lot that goes into these tests. There is a clear standard on how officer's are required to instruct and demonstrate them. I will look at this in detail. And if something wasn't done correctly, it can be challenged. Let's talk about it soon, so you have some context about these tests and how you performed.
Will I lose my license?
If you’re charged with DWI in North Carolina, your license can be suspended immediately. But there are ways to contest or delay that. I’ll guide you through it. If you are convicted of a DWI you will lose your license for at least a year. But you may be eligible for a limited driving privilege. Hence, the importance of contacting me soon to discuss your options. Call now to talk about protecting your license.
Can my charge be dropped or reduced?
It’s possible. I look at every detail of the stop and the testing process. If something was mishandled, it can be challenged.
Do I need to go to court?
Yes, in most DWI cases you’ll need to appear, but I’ll walk you through exactly what to expect and be there with you.
